Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") set forth the terms and conditions for the use of the services provided by Us (including this site, hereinafter collectively referred to as "the Service"). These Terms apply to all users who use the Service.

Definitions

In these Terms, the following terms shall have the meanings set forth below:

• "User" refers to an individual or entity that uses the Service.
• "We," "Us," or "Our" refers to the operator providing the Service.
• "The Service" refers to the collective term for all services, features, and content provided by Us.

• "Output Data" refers to the content generated as a result of the Service processing the Input Data provided by the User and returned to the User.

Agreement to these Terms

• By using the Service, the User is deemed to have validly and irrevocably agreed to these Terms.
• Users who do not agree to these Terms may not use the Service.
• You must be 18 years or older to use the Service.

User Registration

Those wishing to use the Service may register for use by agreeing to these Terms, applying for user registration according to the method prescribed by Us, and upon Our approval thereof.

Registration Denial

We may choose not to approve an application for user registration if We determine that any of the following reasons exist. We are under no obligation to disclose the reasons for denying registration.

• If false information was reported.
• If the application is from someone who has previously violated these Terms.
• If We otherwise determine that user registration is inappropriate.

Management of Login Information

Users shall manage their login information for the Service appropriately at their own responsibility. Under no circumstances may Users transfer or lend their login information to a third party, or share it with a third party. We shall not be liable for any damage caused by the use of login information by a third party, except in cases of Our willful misconduct or gross negligence.

Subscriptions

The price of products and services related to the paid subscription plans offered by Us, any other necessary costs, the payment method and timing of payments, the delivery time of products or provision time of services, and the possibility of mid-term cancellation are determined by Our Statement based on the Specified Commercial Transactions Act.

We will automatically charge Your payment method for each agreed-upon recurring renewal until You cancel. All applicable taxes are the User's responsibility and will be charged as required.

If payment is not completed, We may downgrade Your account or suspend Your access to Our services until payment is received.

We may change prices from time to time. If We increase the subscription fee, We will notify You at least 30 days in advance, and the increase will apply at the next renewal. If You do not agree to the price increase, You may cancel the service.

Service Provision in Case of Mid-Term Cancellation

In the event of mid-term cancellation, the products, services, and content included in the paid subscription plan will no longer be available from the time of cancellation.

Use of the Service

Users shall understand and agree to the following when using the Service:

• Output Data may not always be accurate.
• Users must evaluate the accuracy and appropriateness of Output Data before using or sharing it.
• Do not use the Service as a substitute for medical, legal, financial, or other professional advice.
• Users shall prepare and maintain, at their own responsibility and expense, the necessary equipment, software, communication means, and other access environments required to use the Service.
• The Service may be automatically updated to ensure You are using the latest and optimal version. This includes updates to AI models.

Points

We may issue points unique to Us or the Service. Details in such cases will be determined separately within the Service or at other locations designated by Us.

Cryptocurrency

We may issue cryptocurrency unique to Us or the Service (hereinafter referred to as "this Cryptocurrency").

Late Payment Penalty

Users who delay payment of monetary obligations to Us shall pay Us late payment damages at an annual rate of 14.6%.

Handling of Data

• Users represent and warrant that they have the legitimate right to input and use the Input Data.
• We will not disclose User's Input Data and Output Data to third parties without the prior consent of the User, except in the following cases:
• When disclosure is required by law.
• When necessary for the protection of human life, body, or property, and it is difficult to obtain the User's consent.
• When particularly necessary for improving public health or promoting the sound development of children, and it is difficult to obtain the User's consent.
• The User confirms that the copyright of the Output Data generated through the use of the Service belongs to the User. However, if the Input Data used to generate the Output Data contains copyrighted works of third parties, the User shall handle the rights relationship at their own responsibility.
• In principle, We do not view, disclose, modify, delete, or otherwise manage the data (Input Data and Output Data) created and managed by Users through the Service. However, this does not apply when necessary, such as for user support or responding to violations of the Terms of Service.
• Even if an administrator with authority is set, content, Input Data, and Output Data created by a specific User cannot be viewed, disclosed, modified, or deleted by that User's superiors or other users. Furthermore, We will not comply if an administrator requests Us to do so.
• We are not obligated to back up User's Input Data and Output Data. Users shall back up their data at their own responsibility as necessary.
• We may delete User's Input Data and Output Data in the event of unavoidable circumstances such as the termination of the Service.

Prohibited Acts

Users shall not engage in the following acts when using the Service:

• Acts that violate laws, court judgments, decisions or orders, or legally binding administrative measures, or acts that promote such violations.
• Acts related to criminal activity.
• Acts that infringe upon the intellectual property rights of Us or third parties.
• Acts that infringe upon the portrait rights, privacy, honor, or other rights or interests of Us or third parties.
• Acts that place an excessive burden on or interfere with the normal operation of Our or third parties' servers or networks.
• Acts that may interfere with the operation of Our services.
• Unauthorized access or attempts thereof.
• Analyzing the source code of the Service through disassembly, decompilation, reverse engineering, etc.
• Unauthorized access to systems connected to the Service, or unauthorized rewriting or deletion of information stored in Our facilities.
• Copying, transmitting, transferring, lending, or modifying the Service's website or software.
• Lending, transferring, selling, etc., accounts or content on the Service to third parties for a fee.
• Acts aimed at obtaining benefits related to the Service through methods not intended by Us.
• Advertising, soliciting, or engaging in sales activities on the Service that are not permitted by Us.
• Using the Service for the purpose of imposing a burden on Us.
• Collecting or accumulating personal information, etc., concerning other Users.
• Using the Service for illegal, fraudulent, or improper purposes.
• Acts that cause disadvantage, damage, or discomfort to other users of the Service or other third parties.
• Impersonating other users.
• Using the accounts of other users.
• Acts aimed at meeting unacquainted persons of the opposite sex.
• Providing benefits directly or indirectly to anti-social forces.
• Acts that violate public order and morals.
• Using the Service while walking, driving a vehicle, or in other situations or manners where the use of the Service is inappropriate.
• Other acts that We deem inappropriate.

Transmitting the following types of information through the Service:

• Information containing violent or cruel expressions.
• Information containing computer viruses or other harmful computer programs.
• Information containing expressions that damage the privacy, honor, or credibility of others.
• Information containing obscene expressions.
• Information containing expressions that promote discrimination.
• Information containing expressions that promote suicide or self-harm.
• Information containing expressions that promote the inappropriate use of drugs.
• Information containing anti-social expressions.
• Information seeking the dissemination of information to third parties, such as chain mail.
• Information containing expressions that cause discomfort.

Exclusion of Anti-Social Forces

The User represents and warrants that none of the following items apply now and will not apply in the future:

• That the User (or its officers, if the User is a corporation or other entity) is an organized crime group, a member of an organized crime group, a person for whom five years have not passed since ceasing to be a member of an organized crime group, an associate member of an organized crime group, a company affiliated with an organized crime group, a corporate racketeer (sokaiya), a group engaging in criminal activities under the guise of social movements, etc., a special intelligence violent group, or other similar persons (collectively referred to as "Organized Crime Group Members, etc.").
• If the User is a corporation or other entity, having a relationship where Organized Crime Group Members, etc. are recognized as controlling the management.
• If the User is a corporation or other entity, having a relationship where Organized Crime Group Members, etc. are recognized as substantially involved in the management.
• Having a relationship recognized as using Organized Crime Group Members, etc., such as conducting transactions for the purpose of seeking illicit profits for oneself or a third party, or for the purpose of causing damage to a third party.
• Having a relationship recognized as being involved in providing funds, etc., or providing favors to Organized Crime Group Members, etc.
• If the User is a corporation or other entity, having a relationship where its officers or persons substantially involved in its management have socially reprehensible relationships with Organized Crime Group Members, etc.

The User warrants that they will not perform any of the following acts, either themselves or through a third party:

• Violent demands.
• Unreasonable demands exceeding legal responsibility.
• Threatening behavior or use of violence in connection with transactions.
• Spreading rumors, using fraudulent means, or using force to damage Our credibility or interfere with Our business.
• Other acts similar to the preceding items.

Usage Restrictions

We may restrict the use of all or part of the Service for a User or cancel their registration as a User without prior notice if any of the following apply. We shall not be liable for any damage incurred by the User as a result of actions taken by Us based on this article.

• If any provision of these Terms is violated.
• If it is found that there is false information in the registered items.
• If there is a default in payment of monetary obligations.
• If there is no response to communications from Us for a considerable period.
• If the Service has not been used for a considerable period since the last use.
• If We determine that the User is an anti-social force, etc., or has some form of interaction or involvement with anti-social forces, etc.
• If We otherwise determine that the use of the Service is inappropriate.

Suspension of Service Provision

We may suspend or interrupt the provision of all or part of the Service without prior notice to the User if We determine that any of the following reasons exist. We shall not be liable for any disadvantage or damage suffered by the User or third parties in such cases.

• When performing maintenance inspections or updates of the computer system related to the Service.
• When provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, natural disasters, or the spread of viruses.
• When computers or communication lines stop due to accidents.
• When We otherwise determine that the provision of the Service is difficult.

Withdrawal

Users may cancel their user registration and withdraw from the Service according to the procedures established by Us.

Disclaimer of Warranties

We do not warrant that the Service or the content provided by the Service is free from system bugs or infringement of third-party rights. Nor do We warrant safety, reliability, accuracy, completeness, validity, or fitness for a particular purpose.

Limitation of Liability

We shall not be liable for any damages incurred by the User in relation to the Service. However, this disclaimer does not apply if the contract between Us and the User regarding the Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act.

Even in cases that fall under consumer contracts, We shall only be liable for damages directly and actually incurred by the User due to Our negligence (excluding gross negligence), and the amount of compensation shall be limited to the lower of the usage fee for the Service for the most recent month or 10,000 yen.

Changes to Service Content

We may change the content of the Service or discontinue or terminate the provision of the Service without notifying the User. We shall not be liable for any damages incurred by the User as a result.

Changes to Terms of Service

We may change these Terms at any time without notifying the User. The revised Terms shall become effective from the time they are posted on Our website. Users who continue to use the Service after changes to these Terms are deemed to have agreed to the revised Terms.

Handling of Personal Information

Personal information of Users acquired through the use of the Service shall be handled appropriately in accordance with Our Privacy Policy.

Notices or Communications

Notices or communications between the User and Us shall be made by the method prescribed by Us. Unless the User notifies Us of changes according to the separately prescribed format, We will consider the currently registered contact information to be valid and send notices or communications to that contact information, which shall be deemed to have reached the User at the time of transmission.

Assignment of Rights and Obligations

Users may not assign their status under the usage contract or their rights or obligations under these Terms to a third party or offer them as security without Our prior written consent.

Business Transfer

In the event that We transfer the business related to the Service to another company (including business transfers, company splits, and any other cases where the business is transferred), We may transfer the status under the usage contract, rights and obligations under these Terms, and User information to the transferee of said business transfer. Users shall be deemed to have consented in advance to such transfer.

Applicability

These Terms shall apply to all relationships between the User and Us regarding the use of the Service.

In addition to these Terms, We may establish rules for the use of the Service. These rules, regardless of their name, shall constitute part of these Terms. If these Terms conflict with such rules, the rules shall take precedence.

Severability

Even if any provision of these Terms or part thereof is determined to be invalid or unenforceable, such determination shall not affect the other parts, and the remaining parts of these Terms shall continue to be valid and enforceable.

Governing Law and Jurisdiction

The interpretation of these Terms shall be governed by the laws of Japan.

Any disputes arising in connection with the Service shall be subject to the exclusive agreed jurisdiction of the district court having jurisdiction over Our head office location.
